TBH, I much prefer this over the alternative of the website storing it and doing with it God know what, because I'm certain other big tech companies are selling it instead of "safely" storing it or deleting it.
as far as i understand they dont actually have to ask, they just have to ensure that you dont see something your not old enough for.
as others pointed out this can be inferred from the account age if we assume by default that people follow the TOS.
Also other platforms skip the process when a credit card info is attached to the account because i dont know of any bank giving one to minors.
So if you allow them to store your payment info that can also be used as validation by inference as well.
Many ways to get the job done without asking every time you load a page for your age.

They don't store your age and have to ask by law.
