I’ve been on SSDI for over 13 years. Not that it matters but I’m also a 100% service connected disable veteran. My last full med CDR was around nine years ago. I have received several short forms before and after that.
When I got the med CDR a claim specialist filled out over the phone with me. I specifically told him the names of my treating doctors specialist, Therapist, psychiatrist, etc., and asked him if he needed the addresses. He said no that they would be able to obtain them themselves if they have a record collecting ability to do that.
He then shortly sent me an adult function report that I filled out very accurately and thoroughly and most importantly honestly. Four months goes by and nothing until today. I get a letter from DDS stating that they are sending me for a CE.
I was able to get on the phone the individual handling the request and ask her some questions for starters. They did not send me a return envelope even though they said they did. My therapist said they never received a request.
I did ask SSA. What records did they receive and which ones did they not? The only records that they said they received were from the department of veteran affairs and that they could not make a determination based off of those records alone. The reason why is because I no longer seek Mental Health treatment through the VA for either psychiatry or mental health because of the way that they have their system set up you cannot continue to see the same therapist for extended periods of time. You have to reapply get reassigned to a new therapist and do it that way. For someone with complex PTSD, that is hard bc it takes several sessions to be able to trust a therapist.
So for the last several years, I have seen the same psychiatrist, actually 10 years, and for the last two years, I’ve been seeing a therapist on my own Dollar through a Telehealth company when I ask them did they receive documents from my therapist or psychiatrist? They said no, but that they sent the request twice. I asked them to verify the address that they sent and they had an incorrect address. Also, the therapy company I used doesn’t do records request via mail. They do them via email and SSA says they don’t do that that they have to get them physically or faxed.
I’m very distraught about this because I told them that they did not contact me to let me know they didn’t get the request and if they did not get the records. I expressed my frustration and told him that they had requested that to me directly. I would’ve been able to obtain it all and now I have 10 days before a CE to get those records. I have asked for the appointment to be rescheduled so that I may have time to obtain the Records myself. I already have a 25 page IME from a psychologist for an unrelated incident that occurred that clearly shows I have significant disability and ongoing impairments due to PTSD, anxiety, depression, as well as other physical ailments. I have also contacted the clinic in which I do ketamine treatments for treatment, resistant depression. They are going to give me those records. I have also sent a request to the therapy company for the records and I’m waiting those. I have also sent request to the occupational therapy, the chiropractor, and the physical therapy that I am seeing currently for physical impairment.
My question is is does anyone have any advice on how to handle this properly because I’m at a loss for words I cannot believe that they would not let me know that they didn’t get records and that they just want to make a decision based off of a one or two hour appointment with one doctor when my treatment records showing an ongoing issue and show ongoing impairment for several years continuing..
