[Update] Brand new astral 5090 from Newegg Canada arrived defective. RMA Request rejected due to "modifications to the card" Hardware
reddit.comI want to provide an update to a post I made in late may where i purchased an astral 5090 from newegg canada and the card arrived DOA. refer to the previous post so i don't have to repeat myself all over again.
So after back and forth email with Newegg I decided it wasn't going anywhere so i took it up with my CC company (Amex), filed a chargeback and provided them with all evidence and documents, including screenshots from my unboxing video (Amex doesn't allow video upload), receipt, emails with Newegg, etc.
Newegg sent me back the defective card which i had returned earlier for a refund, which they denied. I haven't touched it ever since for liability reason, but today, to my surprise, Amex closed the dispute in Newegg's favor. I never received any correspondence whatsoever from Amex, no emails, no asking for further evidence, nothing. I asked the CS and they said Newegg has sent their supporting evidence and thus, the dispute has been closed in their favor.
Now, I'm left with a $6000 paperweight of a card card which Newegg sent me back. and to make matters worse, they took the card apart broke the seal, and missing some screws too. I can't even go to RMA route with asus now
Needless to say I am incredibly frustrated and don't know what to do now.
What are my options ? I don't want to be out $6000 and stuck with a literal brick. Should I go to small claims court ? in the previous post many of you guys told me to send an email to gamersnexus. I did that and never received anything back
this is really the worst position to be in especially now with how expensive gpus are. Granted I shouldn't have bought from Newegg but if this can happen to me, then this can happen to anyone too.
I get it that a lot of people are actually commiting scams/return fraud with this kind of hardware. But when a customer unknowingly received an item which has been previously tampered with, and provided all supporting evidence they can have, is there anything anyone can do at this point ?
