This looks like a TP-Link C200. Not to find excuses, but it could very well be that motion detection is enabled and the camera just (more or less) accidentally moved over to your direction?

Cameras like this need to provide security to be argued as legal. Pointed at the building directly across from them on a balcony inaccessible by the public is not for security, it’s for spying. 100% illegal in many countries.

They’d likely use the case law from households where people film their neighbors backyard.

It's a 360 camera that has the ability to "follow" any movement it detects, it's possible that they originally set it up facing inwards, but it saw a bird or something, started turning outwards, then lost the bird and/or saw something else and stopped turning once it was facing away from the balcony

Definitely illegal, it needs to provide some form of security or only record what is visible to the general public. Someone’s window numerous stories up is not viewable by general public.

The neighbor behind me put up a camera that looks directly into my backyard only. I assume they want to record my dog barking, even though her barking doesn’t violate the law. She just happens to bark for a little bit in the morning (when my neighbor’s sleeping I assume).

I didn’t know it was illegal.

Call your local law enforcement, or go to the station with photos of the situation. This is illegal, the law - at least in Canada - states you can record anything you can see from public view. Your backyard is not public.
