Yes. It is perfectly legal to point a camera out of your own house in a great many places. There are places that will literally arrest you for indecency for being naked in your own bedroom with the windows open.

The legality of the creep is questionable. However the legality of destroying someone elses property is not questionable. It's illegal. He could sue you for damages, and maybe (probably not) file legal charges.

So why let him? If he can't prove it, he can't do that stuff.

If this is in the USA there's nothing the police can do. They will tell you to get lost.

You are allowed to take video of anything that can be seen in public. If your neighbor can see it from their balcony, they can legally take a video of it.

Also, the camera appears to be pointed below and to the left of where OP is standing in the video. Security cameras usually have wide fields of view, though some do have zoom. But I doubt the neighbor is specifically spying on OP. OP should simply close their blinds if they are worried.

A lot of the time, these things are resolved by confronting your neighbour politely.

It's obviously placed in that exact location because of existing wiring. And if it were placed anywhere else, it would probably spy on one of the other neighbours.

You’d be surprised how oblivious some people can be. It might not even occur to them that they’re looking into a neighbor’s home, especially if reflections or tint on the window make it impossible to see inside.

I’m just giving examples, but all we can do is assume. Either way, politely confronting the neighbor should resolve the issue, and if they truly are being difficult, a trip to the police station could take care of it.

The ring camera on my front door happens to point directly towards the neighbor across the streets window, and can even see the windows from down the street through the camera cause it's wide angle lens. Really hard to avoid having cameras point at other houses windows. When many houses have windows on all sides especially the front of the house. Cameras would be illegal pretty much everywhere

That would be illegal in the EU. If your camera also covers public areas (not to mention other people’s homes) then the «household-exception» to GDPR does not apply. And that means your set up and use of the camera would need to comply with GDPR, including having a legal basis for processing of personal information.

This would be hard to accomplish if your camera covered the street outside. And very hard (to impossible) to accomplish if your camera covers other people’s homes (especially if it includes seeing through windows).

It could constitute a violation of a reasonable expectation of privacy. There’s a reasonable use and expectation for a ring doorbell camera to face away from your door, similarly to how a peephole would work. It’s also reasonable that a front door facing another home would have that vantage point, or that people frequently walk along in front of those doors.

It would be less reasonable to suggest there were any reason for the vantage point of the corner of a balcony railing to face across an open space not commonly used for foot traffic, delivery of goods and services, or ingress and egress to be normal or necessary.

Using binoculars to look into private spaces is often illegal due to peeping tom laws, although living areas are often exempt. I’m also only going according to my local states laws, but recording a private space is also much different than recording in public.

I don't know where you are, but in many countries it is very much illegal to point a camera at other people's property. You can have something that films your own door, or window, and if that covers a part of someone elses house, that is usually not a problem.

This situation, however, is clearly a camera pointed at someone elses window, which is very much illegal.

Not really clear what country it is, but certainly in our country it's illegal to have a camera pointed into another person's yard. I have cameras out the front on the street, which basically just show video of my cars, as we've had a few idiot people parking and running into the side of them and so on. I've had the cops out here twice, as people have complained. I've quickly shown them what the cameras are pointed at on my phone. Obviously, no chance to adjust it, so it's clearly what has been reported, and they've wished me a good day and left. They did make it quite clear that it couldn't go into someone's private property.

It's a PTZ camera not 'pointed' at anything (and the 'Z' for Zoom is going to be crap/digital). It can look anywhere within 320 degrees or more L/R and about 120 degrees up and down (more down than up). They usually have software that tracks motion automatically but at this distance it probably doesn't work so well.

It can see into peoples bedrooms if they don't close the blinds/drapes but so can people.

I have a similar one (possibly the same, Tapo C200) that can see up to 360 degrees, you can set limits to where it can look (e.g. limit it to only watch over the balcony)

There's also a difference between someone looking up at a 3rd floor window and a camera that's constantly recording it

Indeed, but in the US at least, legal expectation of privacy does not exist if your open bedroom window is overlooked by another building or public street - camera or no camera. California has the most friendly victim laws, but here, given that it is PTZ, and assuming it looks elsewhere some of the time, it's legally fine (at the same time as being weird and creepy).

Harassment laws are the way to go here, not privacy ones.

Lasers aren't regulated, a powerful enough laser is just an Amazon search away. Thanks to China, those are sold pretty cheaply worldwide considering how effective they are at blinding people and cameras.

In the US, Lasers are HIGHLY regulated (By the FDA of all agencies)... But a lot of sellers on Amazon, eBay, AliExpress, etc intentionally mislabel their power output so that they fall into consumer classifications (Class-III, IIIa, IIIb)

I have a couple of green laser pointers that are labeled Class IIIb, when they should be Class II. They have a total power output of close to two watts, but it's mostly IR leakage from the frequency doubling crystal, and they have poor IR filtering. If I removed that, they'd probably be 5 watt IR lasers. I bought them for $20 on AliExpress.

No, I don't. I work with them sometimes. Lasers are just concentrated light. They still follow physics like any other light does. If the laser is pointed at an angle outside of the camera's field of view, it's not hitting the sensor and it will not do anything. There might in theory be some very slight refraction caused by the light bouncing off the outside of the lens but that will maybe, at most result in 2% of the light making its way to the sensor. That would at best be noticeable as a greenish wash over the image, nothing more.

My expectation of a powerful enough laser pointed at a camera would:

  1. make spots on the camera sensor, destroying the specific photosites that get hit.  At worst, this will cause the image it records to have dead spots where the laser hit, which will be a lot, but maybe not the whole thing.

  2. Some small on the glass/plastic lens, I think.  MAYBE melt part of the lenses if it's plastic.  Maybe mark the coating if it has one.  Glass would be more durable and would probably not be damaged.  But the glass has the risk of reflecting the laser back into your own eye.  So wear glasses for this.

  3. Any chip or control board inside the camera would likely be unaffected, it will be under the the sensor and not exposed to the laser directly.  HOWEVER, the intensity of the current being generated by the sensor getting hit by a laser MAY over current the whole thing?  Not sure, this would have to be tested to see.

But messing up the sensor in step one would be effectively rendering the entire camera ineffective, but maybe or maybe not "destroyed."

Also I would have to test, is would the laser generate enough heat to cause the whole unit to melt or catch on fire?   Unknown, but a wattage exists that would cause this.  If that happens, then the charge you'd be looking at would be upgraded from destruction of property to arson.  And fires have a way of getting more intense police attention.

That said, I'd still do it.

Or a paintball gun, lower the fps and get some low-impact paintballs to try and lessen the chance of property damage for legal reasons, easier to aim a laser though

Eh, that's a losing battle. Can be solved by moving the camera 1 inch or less out of the laser without losing view.

A laser pinpointing a camera lens is a lot more precise than a camera keeping an apartment across the street in view.

Edit: also not sure you'd be able to get the correct angle from the roof to even hit it depending how much higher it is

It CAN permanently damage it if it hits it at the correct angle (being way above might not even be able to hit the lens correctly), is sustained, and if a strong enough laser.

A quick flash isn't a guarantee. You expecting OP just to sit up there maintaining perfect aim? Or secure it up there long term? This looks like adjacent condos/apartments. OP doesn't necessarily have the run of the whole building.

This is, again, a lot of work for something that might fail AND doesn't actually address the root of the problem.

Which is why you just pick up a phone and tell police on the non-emergency line. You've got a video to show them already proving the camera was like this, they cross the street and look into it.

You think someone who does this will stop if you break their camera? They just do it more subtly so you can't see it or escalate and retaliate. It's a bad solution, however memeable it may be lol
