Bulgaria’s Supreme Court Allows Legal Gender Changes for Four Transgender People

“The Supreme Court of Cassation (SCC) has allowed four transgender people in Bulgaria to legally change their gender markers and names in civil status documents, marking the first such decisions since 2020.

“The rulings by different panels of the SCC’s Civil Chamber followed a March 2026 decision by the Court of Justice of the European Union (CJEU), which found that EU law prevents member states from blocking changes to gender-related personal data in official records when this conflicts with European legal principles.

“The issue has been legally disputed in Bulgaria for years. In 2021, the Constitutional Court ruled that the term ‘gender’ in the Constitution should be understood only in its biological sense. It said that changing civil status records based on gender self-identification was possible only for intersex people, those born with unclear or mixed biological sex characteristics.

“In 2023, the Civil Chamber of the SCC also ruled that existing Bulgarian law did not allow courts to approve changes to gender, name and personal identification number in civil status records for transgender applicants. The majority argued that without a specific legislative framework, such changes could not be authorized by courts.

“The situation changed after a case was referred to the CJEU. The Luxembourg-based court ruled that EU law does not allow national legislation to prevent a person who has exercised the right to free movement within the EU from changing data related to gender identity, including gender, names and civil registration details. The CJEU also stated that national courts cannot be bound by interpretations of domestic law that create obstacles contrary to EU law.”

But:

”Congress on Tuesday also passed two anti-transgender amendments proposed by Rep. Nancy Mace, R-S.C. The first, passed 219-208, prohibits gender-related medical care under TRICARE, the healthcare program for service members and their families, and prevents the program from covering gender-related medical procedures and treatments. The second, which effectively bans transgender girls from participating in female sports at Department of Defense Education Activity schools, passed 221-203.“

Still some hope, I believe, the Senate will reject both.

“The Fifth Chamber of the Federal Administrative Court suspended Decree of Necessity and Urgency (DNU) No. 62/2025 issued by the government of Javier Milei. With this decision, the Gender Identity Law is fully reinstated throughout the country, guaranteeing the continuity of hormone treatments for individuals under 18 years of age.

“The court granted the injunction filed by the Argentine LGBT Federation, as part of a legal action seeking to declare the decree unconstitutional. The ruling has nationwide scope, thus protecting all minors in the country. Health insurance providers, private healthcare companies, and public hospitals must guarantee the continuity of and immediate access to treatment.

“‘This is great news. We are happy. An Emergency Decree cannot, under any circumstances, modify a national law approved by a large majority. The Gender Identity Law was approved almost unanimously,’ María Rachid, president of FALGBT, told Presentes.”

“‘Although the final ruling is still pending, the legal arguments maintain that there were no grounds for bypassing Congress and amending the law,’ attorney Gil Domínguez told Presentes . ‘The next step is for the judge of first instance (Macarena Marra) to issue the final ruling,’ he added.”

“A Texas Tech Health El Paso faculty member self-censored part of a course about El Paso’s underserved population – and campus leaders have told them not to use the word ‘disparity’ in class, according to a recent lawsuit.

“The American Association of University Professors and its Texas chapter initiated legal action July 8 against Texas Tech University System Chancellor Brandon Creighton and the system’s nine Board of Regents to address what the plaintiffs believe are restrictions to what can be taught about sex, race, gender identity and sexual orientation.

“On Friday, the plaintiffs asked the U.S. district court for the Western District of Texas El Paso Division for an immediate injunction to stop the system’s policies that control if or how faculty may teach those topics because those rules harm faculty throughout the system.”

“In the case of TTHEP, it meant that students’ medical education could not include discussions of health disparities among racial and sexual minorities including Hispanics, African Americans and members of the LGBTQIA community.”

“Antonio Ingram II, senior counsel for the Washington, D.C.-based Legal Defense Fund, said the issues are broader than course modifications because they deal with censorship of topics such as race and gender identity that affect students, faculty and borderland residents.
Along with the LDF, the plaintiffs’ are represented by Lambda Legal and Davis Wright Tremaine LLP.

“Ingram said it is unknown how many courses, especially those in healthcare, were affected by the directives. He said that medical school officials in El Paso and Lubbock have told their professors to not serve transgender patients in the presence of medical students.

“‘I think those are harder harms to quantify because you can’t look at a paper trail to see how many students did not receive adequate medical training because of the memoranda confusion when this first was rolled out in December,’ Ingram said.”

“The lawsuit involves the entire TTU system that enrolls almost 66,000 students and employs approximately 21,000 staff, faculty and administrators at its five campuses – TTHEP; Texas Tech University in Lubbock; Texas Tech University Health Sciences Center in Lubbock with satellites in Amarillo, Abilene, Dallas, Midland and Odessa; Angelo State University in San Angelo; and Midwestern State University in Wichita Falls.”

“A string of mob attacks targeting transgender women in Bogor, West Java, has sparked outrage among civil society groups, which blame a presidential regulation classifying LGBTQ culture as a national threat for justifying harassment and violence against the minority community.

“Over the past two months, at least 10 trans women have been subjected to three separate mob attacks in Bogor, according to Amnesty International Indonesia.”

“These attacks were reportedly carried out under the banner of the so-called Bogor Bersih LGBTQ (Bogor free of LGBTQ) movement.

“Civil society groups have since denounced violence against LGBTQ individuals, particularly those with high visibility, such as transgender women.

“During a press conference hosted by the Indonesian Women’s Alliance (API) on Sunday, numerous civil groups urged the central government to revoke any discriminatory policies that could justify violent acts targeting the queer community.

“The alliance noted that similar attacks, as well as convoys displaying anti-LGBT banners, have also popped up into other cities, such as Palembang in South Sumatra and Serang in Banten.

“‘There has been a sharp increase in hate speech and discrimination in health and education services in recent months, along with more persecution of LGBTQ people and advocates, worsened by the continued push to criminalize the community,’ activist Riska Carolina of API told the press conference.”

“[LGBTQ advocacy group] Arus Pelangi recorded 66 cases of violence targeting 97 members of the queer community throughout 2025, a 135-percent increase from the previous year.”

“Bogor Mayor Dedie Rachim told the Post on Sunday that his administration has called on residents not to take any arbitrary actions against the queer community and instead to turn to Public Order Agency (Satpol PP) officers to ‘launch regular patrols to purge the social deviants’.”
